Please read these Terms of Use (“Terms”, “Terms of Service”) carefully before using the AdiosTextbook website operated by Creative Language Class (the “Service”) (AdiosTextbook/Creative Language Class may be referred to hereinafter as “us”, “we”, or “our”). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
Main Points
One account for one teacher. No sharing logins.
Do not share the content with others, including on district sites like GoogleDocs. Anyone using the materials has to be an active member.
Account Access
Each membership is for one teacher only. The number of devices on which you can simultaneously access your account is limited. Excess logins from numerous IP addresses may result in membership cancellation without a refund.
You will have immediate access to all the units once you purchase.
Your email will be added to a distribution list for AdiosTextbook and Creative Language Class only. You will receive notifications of new units, new products, and general updates. You may unsubscribe from these at any time.
Billing and Cancellation
All memberships are final purchases. No refunds.
Monthly memberships are automatically renewed each month on the date that you purchased. They can be cancelled at any time on your profile page. You will lose access to the site materials immediately after cancellation. You must cancel your membership before it renews each month (recommended to do at least 2 days prior to the next payment) in order to avoid billing of the next month’s membership fees. You can also contact us to set a specific date for your account to cancel.
It is your responsibility to update payment information if your credit card information changes (new card, change of address, etc.). If your payment fails to process, the membership will automatically be cancelled. No worries… You may sign back up at any time.
Annual memberships do not automatically renew.
Teacher Responsibility
You are responsible for previewing all lessons and links to ensure that they are appropriate for your students and the school’s climate and accessible under your district’s internet filtering system.
You are responsible to preview lessons to plan and adjust the timing of suggested activities for your needs.
Your membership allows you the right to use and modify the materials with your classes and students in accordance to this agreement. This includes creating accommodations for students, such as audiocassettes/recordings/videos. If you are not a member, then you do not have permission to use these materials in any form.
You may share your own experiences from the classroom and your students’ work using materials or content from AdiosTextbook (conference, social media, professional development, etc) with credit to the website and CLC. You may not share/distribute the materials/content with the intention that non-members can use them in their class.
You may share and upload the handouts/downloads from AdiosTextbook with your own students on your private and protected sites (Edmodo, Schoology, GoogleClassroom, etc). You may not publicly post/share any images, downloaded materials, or other lesson content created by AdiosTextbook on public sites (including, but not limited to, open GoogleDoc and Canvas sites) without permission. Any violations may result in cancellation without refund and legal action may be taken.
Links To Other Web Sites
Our site may contain links to third party web sites or services that are not owned or controlled by AdiosTextbook/Creative Language Class. AdiosTextbook/Creative Language Class has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that AdiosTextbook/Creative Language Class shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit. As an Amazon Associate, we earn from qualifying purchases that are linked as suggested items.
Communications
By becoming a member or a user of our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send. Personal information is collected in order to provide you with the use of our services and we will not sell or rent your personal information to marketers or third parties.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
District Responsibility (applies to schools/districts that purchase)
The district may not save, store or share materials and content from the site (including but not limited to assessments, planning sheets, unit objectives, images, etc) on its servers, websites or GoogleDocs. Districts may reference the materials and content with members by using AdiosTextbook links (www.adiostextbook.com/…). Options are available for groups to organize content on the AdiosTextbook site.

How does the vendor store PII data? Is the data encrypted when it’s in a rested state?

Describe the purpose for which the PII will be used.
Names and emails will be used for email campaigns about updates, new products, teaching tips and other communication. Other information that is not required (languages taught, location, age group taught, etc) that the user submits, will be used to specify which email campaign they will receive.
User names, IP addresses and login times/dates are tracked to ensure terms of use are not being violated (sharing login with non-members).
Google Analytics is used to inform us of website behaviors and location, but the information is anonymous. Information is not collected or stored by Creative Language Class. We do not and will not sell PII to any outside company or organization.

Do you ensure the confidentiality of PII by implementing the following:
-password protection – Yes. User controls their username/password through WordPress. AdiosTextbook does not store this information.
-administrative procedures – If PPI is downloaded (Names/emails/additional information) to a computer, it is removed immediately after it is used. Example: To sort emails by language, it has to be downloaded first to computer. After uploading it, the files are deleted/purged from computer.
Annually users and their information that have been inactive for a year are removed from AdiosTextbook site.
Members accept the terms of use and privacy terms when membership is activated. Any changes to privacy/terms of use are updated on the website and they are notified.

At the termination of the contract, what method/process does the vendor utilize to destroy the district’s PII data?
At least once a year, users and their information that have been inactive for a year are removed/deleted from AdiosTextbook site. Also you can contact us directly to request immediate removal.
